On 20 March 2023, UN Committee on Enforced Disappearances called on Iraq to reveal the fate of Iraqi citizen Yahya AL JABOURI, who has disappeared since his abduction on 8 July 2014 from his home.
The UN Committee responsible for monitoring the implementation of the International Convention for the Protection of All Persons from Enforced Disappearance, ratified by Iraq on 23 November 2010, regularly calls on the State party to cooperate in the procedure.
Disappearance of Yahya AL JABOURI
On 8 July 2014, a group of ten men wearing military trousers and ordinary T-shirts broke into Yahya Al Jabouri's house with machine guns, threatening the entire family. The victim and his brother, Moussa Al Jabouri, were both arrested and then driven to an unknown location in vans without license plates under the gaze of several witness.
Since his arrest, the victim's family has been unaware of his fate despite research carried out with the various authorities, including the Ministry of the Interior. Mandated by the victim's family, Al Wissam Humanitarian Assembly Association and Alkarama had submitted Mr. Al Jabouri’s situation to the UN Committee in an urgent communication dated 14 July 2015.
The recommendations of the CED
Despite many years since the victim's disappearance, the Iraqi authorities have still not revealed the fate of Yahya Al Jabouri. The UN body therefore called on Iraq to take all necessary measures to locate him, to investigate without delay his disappearance in accordance with its treaty obligations and to identify those responsible. The Committee demanded that the relatives of the disappeared person be informed of his situation and that they be immediately put in contact with him.
In addition, the Committee requested specific information, corroborated by official documents relating to the research to be carried out, adding that the case of Yahya Al Jabouri will remain open until clarified by the Government. The State party has until 20 April 2022 to clarify the situation of the victim.
