Evidence of Genocide Committed by Israel in Gaza

1. Introduction

On 16 September 2025, the Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel released a report concluding that Israel has committed genocide against the population of Gaza. This report marks a milestone in international efforts to hold perpetrators of grave crimes against humanity accountable.

2. Legal Basis and Establishment of the Commission

Established by Human Rights Council resolution A/HRC/RES/S-30/1 at its 30th special session.
Chaired by former international judge Navi Pillay, with independent experts mandated to investigate grave violations.

3. Key Findings

Israeli forces carried out systematic and large-scale acts targeting civilians in Gaza.
These violations resulted in widespread destruction of civilian infrastructure, mass displacement, and denial of food, medicine, and water.
Under the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, these acts constitute genocide.
The Commission recommended that all States fulfill their legal obligations to stop this crime, prevent its continuation, and prosecute those responsible.

4. Legal Analysis

Article 1 of the 1948 Convention obliges States to prevent and punish genocide.
Genocide is imprescriptible; perpetrators may be prosecuted before the International Criminal Court (ICC) or competent national courts.
States must respect the principle of non-complicity.

The Security Council for referral to the ICC.
